CHAPTER 2.3.13.
BOVINE SPONGIFORM ENCEPHALOPATHY

1.Article 2.3.13.1.¤Î¼¡¤ÎÉôʬ

g) deboned skeletal muscle meat (excluding mechanically separated meat) from cattle
¡Ö30 months of age or less¡× which were not subjected to a stunning process prior to¡¡slaughter, with a device injecting compressed air or gas into the cranial cavity or to a¡¡pithing process, and which ¡Öwere subject to¡× passed ante-mortem and post-mortem¡¡inspections ¡Öand were not suspect or confirmed BSE cases;¡× and which has been prepared in a¡¡manner to avoid contamination with tissues listed in Article 2.3.13.13.;

2.Article 2.3.13.2.¤Î¼¡¤ÎÉôʬ
1. the outcome of a risk assessment (which is reviewed annually), based on Section 1.3., identifying¡¡all potential factors for BSE occurrence and their historic perspective:
a) Release assessment
Release assessment consists of assessing the likelihood that the BSE ¡Ö a transmissible¡¡spongiform encephalopathy (TSE)¡×agent has been introduced into the cattle population¡¡from a pre-existing ¡Öagent TSE ¡×in the indigenous ruminant¡¡population or via commodities¡¡potentially contaminated with the BSE¡Öa TSE¡× agent, through a consideration of the¡¡following:
i) the presence or absence of ¡Öanimal TSE agents¡× the BSE agent in the country, zone or¡¡compartment and, if present¡¤evidence regarding¡Ö their¡× its prevalence¡Öbased on the¡¡outcomes of surveillance¡×;

iv) imported live ruminants ¡Öanimals;¡×

The results of any ¡Ösurveillance and other ¡×epidemiological investigation into the disposition¡¡of the commodities identified above¡Ö(especially surveillance for BSE conducted¡¡on the cattle¡¡population) relevant to the above¡× should be¡¡taken into account in carrying out the¡¡assessment.

When the risk assessment ¡Ö(which takes into account the¡¡surveillance referred to in the release and exposure assessments¡¡above)¡× demonstrates non-negligible¡¡risk, the country¡¡should conduct Type A surveillance in accordance with Appendix 3.8.4.

When the risk assessment¡Ö (which takes into account the¡¡surveillance referred to in the release and exposure assessments¡¡above) demonstrates negligible ¡×fails to demonstrate negligible¡¡risk, the country should¡¡conduct Type B surveillance in accordance with Appendix 3.8.4.

3.Article 2.3.13.3.¤Î¼¡¤ÎÉôʬ

Negligible BSE risk
Commodities from the cattle population of a country, zone or¡¡compartment pose a negligible risk of¡¡transmitting the BSE agent, should the following conditions be met:
1. a risk assessment, as described in point 1) of Article 2.3.13.2., has¡¡been conducted in order to¡¡identify the historical and existing risk¡¡factors, and the country has demonstrated that¡¡appropriate¡¡¡Ögeneric¡× specific measures have been taken for¡¡the relevant period of time defined¡¡below to manage ¡Öall¡¡risks¡× each risk identified;

2. the country has demonstrated that Type B surveillance, in accordance with Appendix 3.8.4, is in
place and the relevant points target, in accordance with Table 1, has been met;

3. EITHER:

b) ¡Öthe last indigenous case of BSE was reported more than 7¡¡years ago ¡×any indigenous case of¡¡BSE was born more¡¡than 8 years ago; and

iii) all BSE cases, as well as:
- ¡Öall the progeny of female cases, born within 2 years prior¡¡to or after clinical onset¡¡of the disease, and¡×

4.Article 2.3.13.4.¤Î¼¡¤ÎÉôʬ

Controlled BSE risk
Commodities from the cattle population of a country, zone or¡¡compartment pose a controlled risk of¡¡transmitting the BSE agent,¡¡should the following conditions be met:
1. a risk assessment, as described in point 1) of Article 2.3.13.2., has¡¡been conducted in order to¡¡identify the historical and existing risk¡¡factors, and the country has demonstrated that¡¡appropriate measures¡¡are being taken, but have not been taken for the relevant period of¡¡time to¡¡manage all risks identified ¡Öthe country has not¡¡demonstrated that appropriate generic measures¡¡have been taken for¡¡the relevant period of time defined below to manage all risks¡¡identified;¡×

2. the country has demonstrated that Type A surveillance in accordance with Appendix 3.8.4. is in
place; Type B surveillance may replace Type A surveillance once the relevant points target, in¡¡accordance with Table 1, is met;

3. EITHER

iii) all BSE cases, as well as:
-¡Ö all the progeny of female cases, born within 2 years prior¡¡to or after clinical onset¡¡of the disease, and¡×

5.Article 2.3.13.6.¤Î¼¡¤ÎÉôʬ

When importing from a country, zone or compartment posing a¡¡negligible BSE risk, Veterinary¡¡Administrations should require:
for all commodities from cattle not listed in point 1) of Article 2.3.13.1.

6.Article 2.3.13.7.¤Î¼¡¤ÎÉôʬ

When importing from a country, zone or compartment posing a controlled BSE risk, Veterinary¡¡Administrations should require:

9.Article 2.3.13.10.¤Î¼¡¤ÎÉôʬ

When importing from a country, zone or compartment posing a controlled BSE risk, Veterinary¡¡Administrations should require:

1. the cattle from which the fresh meat and meat products originate:
¡Öa) are not suspect or confirmed BSE cases;¡×
b) have not been fed meat-and-bone meal or greaves derived from ruminants;
c) ¡Öwere subjected to ¡×passedante-mortem and post-mortem inspections;
d) were not subjected to a stunning process, prior to slaughter, with a device injecting
compressed air or gas into the cranial cavity, or to a pithing process;
2. the fresh meat and meat products ¡Ödo not contain ¡×were produced and handled in a manner which¡¡ensures that such products do not contain and are not contaminated with:

FSIS issued a policy that allows cattle that become nonambulatory due to an acute102 injury after it passes ante mortem policy to proceed to slaughter. This policy is inconsistent with both published regulations and public policy announcements, and is not consistently interpreted and applied by FSIS inspectors. At 2 of the 12 slaughter establishments reviewed, plant records/auditor observations found that for the period June 17, 2004, to April 12, 2005, 29 nonambulatory animals were slaughtered; 20 of them were identified as downers with no documentation of any acute injury. FSIS officials do not believe its policy is contrary to published regulations prohibiting downers from entering the food supply because, in the opinion of the professional VMOs, these animals were healthy and suitable for slaughter after they passed ante mortem inspection.103 We could find no records, other than the plant daily disposition records, documenting the condition of the animals. Stated public policy must be clear and transparent.

The above table reveals the enormous difference between the number of surveillance points assigned to animals classified as clinical suspects compared to those classified as casualty slaughter, fallen stock, routine slaughter. For example, if a 5-year old cow is classified as a ¡Èclinical suspect,¡É it is assigned 750 points, instead only 0.9 or 1.6 points if classified as either ¡Èfallen stock¡É or ¡Ècasualty slaughter,¡É
respectively.148 Therefore, misclassifying the surveillance stream and inaccurate aging of the cattle tested can significantly impact the surveillance points used to estimate the prevalence of BSE.

SEC. 113. PREVENTING CYBERSTALKING.
(a) IN GENERAL.—Paragraph (1) of section 223(h) of the Communications¡¡Act of 1934 (47 U.S.C. 223(h)(1)) is amended—
(1) in subparagraph (A), by striking ¡Æ¡Æand¡Ç¡Ç at the end;
(2) in subparagraph (B), by striking the period at the
end and inserting ¡Æ¡Æ; and¡Ç¡Ç; and
(3) by adding at the end the following new subparagraph:
¡Æ¡Æ(C) in the case of subparagraph (C) of subsection
(a)(1), includes any device or software that can be used¡¡to originate telecommunications or other types of communications¡¡that are transmitted, in whole or in part, by¡¡the Internet (as such term is defined in section 1104 of¡¡the Internet Tax Freedom Act (47 U.S.C. 151 note)).¡Ç¡Ç.
(b) RULE OF CONSTRUCTION.—This section and the amendment¡¡made by this section may not be construed to affect the meaning¡¡given the term ¡Æ¡Ætelecommunications device¡Ç¡Ç in section 223(h)(1)
of the Communications Act of 1934, as in effect before the date¡¡of the enactment of this section.

2.¤³¤ì¤Ë¤·¤¿¤¬¤Ã¤Æ¡¢the Communications¡¡Act ¡¡1934¡¡¤Î³ºÅöÉôʬ¤ò½¤Àµ¤¹¤ë¤È¡¢ ²¼µ­¤Î¤È¤ª¤ê¤È¤Ê¤ë¡£

Whoever -

(1) in the District of Columbia or in interstate or foreign communication by means of telephone -

(C) makes a telephone call or utilizes a telecommunications
device, whether or not conversation or communication ensues,
without disclosing his identity and with intent to annoy, abuse,
threaten, or harass any person at the called number or who receives
the communications;
