2006年1月5日に、 ブッシュ大統領が、「Violence Against Women and Department of Justice Reauthorization Act of 2005」という名の法律に署名したことで、匿名による、 ネット上での、他人に対する非難・誹謗・迷惑行為・嫌がらせに対して、罰則が適用されるのではないかということで、その是非についての論争が沸き起こっているようだ。
この「Violence Against Women and Department of Justice Reauthorization Act of 2005」(VAWA20052)(HR 3402)という法律は、2005年9月28日に、 アメリカ下院を通過(賛成415反対4棄権14)し、2005年12月16日に、アメリカ上院を通過(満場一致)し、2006年1月5日のブッシュ大統領の署名で、 Public Law No: 109-162 となったものだ。
議案提出代表者は、 F. James Sensenbrenner下院議員であリ、2005年7月22日に提出された。
問題の条項は、「Section 113 Preventing cyberstalking.」で、次のように、the Communications Act 1934 の「section 223 Obscene or harassing telephone calls in the District of Columbia or in interstate or foreign communications 」のなかの「section 223 (1)’(1) ‘(h)For purposes of this section— 」を下記のように修正する形になっている。

やや、玉突き衝突的な修正でわかりにくいが、 簡単にいえば、次のようなことになる。
1.「Violence Against Women and Department of Justice Reauthorization Act of 2005」法のSection 113で、
「サイバー・ストーカー防止策」として修正条項を盛り込み、、
2.ここでの修正の対象を、1934年のthe Communications Act の「section 223」とし、
そこにある
「各州間や各国間でのみだらで嫌がらせの電話」規制条項のなかの
「(1)’(1) ‘(h)このセクションの目的」の修正をきめ、
従来の目的に加えて、一部なり全部、インターネットをつかった遠隔地間通信による ものも、section 223の目的に含めることにし、
3.この目的の拡大に伴って、the Communications Actのなかの(a) 禁止対象行為のなかに、インターネットをつかった次のような行為をした人や行為そのものもはいることになり、罰則の対象となる。
すなわち、
「各州間または、外国との間で通信をする人で、下記に該当する人は、タイトル18(CRIMES AND CRIMINAL PROCEDURE PART I - CRIMES 合衆国法典第18編犯罪および刑事手続き)のもとで、罰金を科せられるか、2年以下の懲役、もしくは、その双方の罰に処せられる。
すなわち、身元を明かさずに、、そして、通信を受ける人を、迷惑がらせたり、誹謗したり、脅したり、嫌がらせをしたりすることを意図して、電話や、 遠隔通信デバイス(これには、一部なり全部、インターネットをつかった遠隔地間通信によるものも含む。)を使う人である。」
というものである。
当初、 今回の修正は、従来の電話に加えて、インターネットによるIP電話を対象としたもので、音声のみの対象であり、対話型のコンピュータサービスは、 含まないとの解釈があったが、なお、 その範囲については、解釈が分かれていて、あいまいのようである。
また、この法律では、「身元を明かさない」で、「迷惑行為や誹謗・嫌がらせなどをした。」ことが条件になっており、「匿名性」と「迷惑行為」との二つの用件がととのって、 初めて、該当すると解釈があるが、 では、具体的に「迷惑行為」とは何であるかという点については、修正前のthe Communications Act 同様、 はっきりしていないようである。
もともとの、この「Violence Against Women and Department of Justice Reauthorization Act of 2005」での修正の目的が、その名のとおり、婦女子に対するバイオレンス防止を 目的としたものなのだろうが、この修正項目の中には、このほかに、DNAのデータベース作成など、人権の根幹にも触れかねない修正事項もあるようだ。
この「迷惑行為法」に対する批判も、出ている。
「アメリカ市民自由連合」では、「ある人にとって、迷惑な行為は、他の誰かにとっては、迷惑ではないはずだ。」としている。
また、このような意見もある。
「婦女子をバイオレンスから守るためであるのなら、匿名で、婦女子が、上司からセクシャルハラスメントをうけたことを、 ブログなりサイトで告発しようとしても、かえって、 この法律が妨げになってしまうのではないのか?」という指摘である。
また、地方政府の堕落の実態を、善良な市民が、サイトで告発しようとしても、実名が条件であるならば、かえって、報復を受けることになるのではないのか？」という意見もある。
さらに、 「アメリカ合衆国憲法修正第一条には、「連邦議会は、国教の樹立を重んじ、または宗教上の自由な行為を禁止し、言論もしくは出版の自由、または人民の平穏に集会し、もしくは苦情の救済を政府に請願するための権利を制限する法律を制定することができない。」とされているが、今回の法律は、このアメリカ合衆国憲法修正第一条の趣旨に反するのではないのか？」という意見もある。
