若林農林水産相は１７日、参議院の予算委員会で、野村哲郎議員（自民）と紙智子議員（共産）の質問に答え、「食糧法上、価格を支えるための買い入れはできないが、不作に備えた備蓄はできる。その趣旨の範囲内で（買い入れを）行うことは考えられる」と答え、政府が余剰米の買い入れを検討する方針を明らかにした。
一方、自民党も、１７日、農業基本政策小委員会を開き、政府による余剰米の
買い取りを柱とした緊急コメ対策に着手し、３０万トンの余剰米購入に必要な予算が５００億−７５０億円に上るとの試算を公表、来週までに政府に要求する買い取り量を決める予定。
しかし、この「備蓄を大義名分にした余剰米の買い付け」というスキームについては、WTO規則上、きわめて、疑義があるようだ。
このサイト「International Law and Trade Policy」では、中国の国家備蓄を建前とした穀物や綿の備蓄買い上げについて、中国側は、これがグリーンボックスであると主張しているが、
これについては「Annex 2 of the Agreement on Agriculture Paragraph ３」条項(下記参考4参照)が適用されるとして、
「備蓄の累積量は、食料安全保障のための量として事前目標とされた量に一致しなければならないこと」
「在庫蓄積や在庫取り崩しのプロセスは、財政的に透明化されなければならないこと」
「政府による備蓄食糧の買い付けは、現行の市場価格によって買い付けられ、また、在庫取り崩し販売の時は、その時点での質に応じた国内の市場価格以下で販売されなければならない。」
としている。
従ってWTO規則においては、実質、このスキームにおける農作物の価格支持は、出来なくなるものと、解釈されうるようだ。
上記の点についてのWTOの解釈全文は、下記参考1「WTO-AGRICULTURE: EXPLANATION Domestic support」のとおりであり、このうち、「消費者への価格転嫁を伴わず、生産者への価格支持効果を伴わない」( not involving transfers from consumers and must not have the effect of providing price support to producers)という要件が必要とされている。
さらに、このサイト「Agriculture in the WTO: Limits on Domestic Support」では、下記参考2のとおりの解釈のようで、ここでも、「国家食料備蓄プログラムに含まれ、財政的に透明なこと」( integral to a nationally legislated food security program and be financially transparent)が、求められている。
同じく、このサイト「Review and Clarification of Green Box Criteria」では、下記参考3のような解釈のように「開発や他の目的の追求をするための備蓄」(to pursue rural development and other objectives)であることが求められ、公共財の整備と同等の観点のものであることが必要であるとの見解のようだ。
上記の自民党案では、備蓄量を適正水準とするため今後３０万トンの余剰米を買い入れると仮定し、６０キロ当たり１万−１万５０００円として必要額(単価一万五千円として、三十万トンでは総額七百五十億円が必要)を試算しているという。
一方、10月3日実施のコメ価格センターの第6回入札（定期注文）での落札加重平均価格は、1等60kg当たり1万4397円であったという。
もし、上記のWTO規定の「政府による食糧の購入は、その時点における市場価格で行うものとし、食糧安全保障のための備蓄からの売却は、産品及び品質に係るその時点における国内市場価格を下回らない価格で行う。」にもとづけば、 その時点における市場価格とは、コメ価格センターの値付けラインとなり、これが政府による余剰米の購入価格と一致しなければならないわけで、ここに価格支持的な単価上乗せは、不可能となるはずである。
総じて、この項目は、発展途上国のための救済項目であり、先進国がこの項目に依存することは、きわめて、貿易歪曲的スキームとみなされても、仕方がないのではなかろうか。

国内法令で定める食糧安全保障に係る施策の不可分の一部を成す産品の備蓄の形成及びその保有に関する出費（又は現に徴収されなかった収入）。当該施策の一部を成す産品の民間備蓄に対する政府の援助もこれに含めることができる。 このような備蓄の量及びその形成は、食糧安全保障のみに関してあらかじめ定められた目標に応じたものとする。備蓄の形成及びその処分の過程は、財政的に透明性のあるものでなければならない。政府による食糧の購入は、その時点における市場価格で行うものとし、食糧安全保障のための備蓄からの売却は、産品及び品質に係るその時点における国内市場価格を下回らない価格で行う。

3. Public stockholding for food security purposes*
Expenditures (or revenue foregone) in relation to the accumulation and holding of stocks of productswhich form an integral part of a food security programme identified in national legislation. This may include government aid to private storage of products as part of such a programme.
The volume and accumulation of such stocks shall correspond to predetermined targets related solely to food security. The process of stock accumulation and disposal shall be financially transparent. Food purchases by the government shall be made at current market prices and sales from food security stocks shall be made at no less than the current domestic market price for the product and quality in question.
* For the purposes of paragraph 3 of this Annex, governmental stockholding programmes for food security purposes in developing countries whose operation is transparent and conducted in accordance with officially published objective criteria or guidelines shall be considered to be in conformity with the provisions of this paragraph, including programmes under which stocks of foodstuffs for food security purposes are acquired and released at administered prices, provided that the difference between the acquisition price and the external reference price is accounted for in the AMS.
